Cela s&rsquo;explique par la pr\u00e9sence d&rsquo;incertitudes technologiques. Il y a incertitude technologique lorsque vous ne disposez pas du savoir-faire n\u00e9cessaire pour atteindre votre objectif. Vous ne pouvez pas atteindre vos objectifs de mani\u00e8re fiable avec la technologie actuelle dont vous disposez. Vous savez que quelque chose vous emp\u00eache d&rsquo;atteindre votre objectif : une limitation, un probl\u00e8me ou un obstacle que vous ne savez pas comment surmonter. Vous devez donc vous soumettre \u00e0 la recherche scientifique ou au d\u00e9veloppement exp\u00e9rimental pour atteindre vos objectifs. Voici quelques exemples d&rsquo;incertitudes technologiques :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Comment accro\u00eetre l&rsquo;efficacit\u00e9 d&rsquo;un processus pour lequel aucune solution n&rsquo;est couramment disponible ?<\/li>\n\n\n\n<li>Comment cr\u00e9er une solution pour r\u00e9pondre \u00e0 la demande d&rsquo;un client qui va au-del\u00e0 des capacit\u00e9s existantes, et<\/li>\n\n\n\n<li>Comment int\u00e9grer un logiciel qui pr\u00e9sente des probl\u00e8mes connus avec la plateforme existante.<\/li>\n<\/ul>\n\n\n\n<p>Les incertitudes technologiques peuvent \u00eatre multiples dans les syst\u00e8mes complexes. Il s&rsquo;agit de syst\u00e8mes compos\u00e9s de multiples \u00e9l\u00e9ments qui interagissent les uns avec les autres en vue d&rsquo;un r\u00e9sultat souhait\u00e9. Voici quelques exemples de syst\u00e8mes complexes soumis au financement de la RS&amp;DE :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Processus \u00e0 op\u00e9rations multiples,<\/li>\n\n\n\n<li>Les produits comportant plusieurs composants, et<\/li>\n\n\n\n<li>Les syst\u00e8mes informatiques comportant de nombreux modules.<\/li>\n<\/ul>\n\n\n\n<p>D\u00e9terminer comment les incertitudes technologiques sont li\u00e9es permet de d\u00e9finir le syst\u00e8me en cours de d\u00e9veloppement. Plus le niveau de description des incertitudes associ\u00e9es \u00e0 votre syst\u00e8me est \u00e9lev\u00e9, mieux c&rsquo;est.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong>Il est n\u00e9cessaire d&rsquo;examiner les projets \u00ab\u00a0\u00e0 partir du niveau le plus \u00e9lev\u00e9\u00a0\u00bb, [&#8230;] Examiner chaque petite \u00e9tape reviendrait \u00e0 d\u00e9naturer le projet.<\/strong><\/p>\n<cite><strong>&#8211; Justice Jorre (<\/strong><a href=\"https:\/\/decision.tcc-cci.gc.ca\/tcc-cci\/decisions\/fr\/item\/98243\/index.do?q=Les%20Abeilles%20Service%20de%20Conditionnement\">Le Abeilles Service de Conditionnement Inc. vs Her Majesty the Queen, 2014 TCC 313<\/a><strong>)<\/strong><\/cite><\/blockquote>\n\n\n\n<p>Pour maximiser votre financement de la RS&amp;DE, vous devez examiner vos projets au niveau le plus \u00e9lev\u00e9 possible. Cela permet de s&rsquo;assurer que toutes les activit\u00e9s li\u00e9es \u00e0 l&rsquo;atteinte de votre objectif sont incluses. Il y a quelques points \u00e0 garder \u00e0 l&rsquo;esprit lorsque vous \u00a0\u00bb encadrez \u00a0\u00bb ou discutez d&rsquo;un projet :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Si vous encadrez le projet de RS&amp;DE \u00e0 un niveau trop \u00e9lev\u00e9, le projet deviendra vague et les activit\u00e9s discr\u00e8tes.<\/li>\n\n\n\n<li>Si vous encadrez le projet de RS&amp;DE \u00e0 un niveau trop bas, le travail semble routinier.<\/li>\n\n\n\n<li>Mais si vous encadrez la RS&amp;DE au bon niveau, vous avez une id\u00e9e claire de la fa\u00e7on dont les travaux sont cens\u00e9s r\u00e9pondre aux incertitudes technologiques associ\u00e9es au projet.&nbsp; Toutes les parties du syst\u00e8me en cours de d\u00e9veloppement sont li\u00e9es entre elles.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>Par exemple, imaginons que vous souhaitiez am\u00e9liorer le rendement \u00e9nerg\u00e9tique d&rsquo;une automobile. Vous avez l&rsquo;id\u00e9e d&rsquo;en modifier la forme pour en am\u00e9liorer l&rsquo;a\u00e9rodynamisme.<\/p>\n\n\n\n<p><strong>Cadrage \u00e0 un niveau trop \u00e9lev\u00e9 : <\/strong>Ce projet porterait sur l&rsquo;am\u00e9lioration g\u00e9n\u00e9rale du rendement \u00e9nerg\u00e9tique, ce qui pourrait englober des activit\u00e9s suppl\u00e9mentaires qui ne sont pas li\u00e9es, comme la mise en \u0153uvre de mat\u00e9riaux plus l\u00e9gers, et pourrait \u00eatre trop vague pour \u00eatre \u00e9ligible.<\/p>\n\n\n\n<p><strong>Cadrage \u00e0 un niveau trop bas :<\/strong> Ce projet n&rsquo;\u00e9tudierait que les modifications de la forme de l&rsquo;automobile.<\/p>\n\n\n\n<p><strong>Cadrage au bon niveau :<\/strong> Le bon niveau permet de saisir les effets des changements de forme sur d&rsquo;autres composants. Pour obtenir le bon contour, il faut peut-\u00eatre d\u00e9placer des composants. Ou encore, les changements de forme pourraient affecter la r\u00e9sistance du cadre, ce qui n\u00e9cessiterait de nouvelles techniques de renforcement.<\/p>\n\n\n\n<p>En d\u00e9finissant le syst\u00e8me comme un syst\u00e8me interd\u00e9pendant, vous trouvez le niveau appropri\u00e9 pour saisir la plupart des d\u00e9penses admissibles au titre de la RS&amp;DE sans compromettre l&rsquo;admissibilit\u00e9.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-les-tribunaux-considerent-les-projets-au-niveau-le-plus-eleve\"><strong>Les tribunaux consid\u00e8rent les projets au niveau le plus \u00e9lev\u00e9<\/strong><\/h2>\n\n\n\n<p>Cette approche des projets de RS&amp;DE fond\u00e9e sur l&rsquo;incertitude du syst\u00e8me a \u00e9t\u00e9 approuv\u00e9e par la principale autorit\u00e9 en mati\u00e8re de RS&amp;DE, la Cour canadienne de l&rsquo;imp\u00f4t.<\/p>\n\n\n\n<p>Dans <a href=\"https:\/\/decision.tcc-cci.gc.ca\/tcc-cci\/decisions\/fr\/item\/108839\/index.do\">l&rsquo;affaire 6379249 Canada Inc. contre Sa Majest\u00e9 la Reine (2015 CCI 77)<\/a>, le demandeur avait mis au point une imprimante sans fil. Ils ont revendiqu\u00e9 des travaux li\u00e9s \u00e0 la r\u00e9solution de probl\u00e8mes li\u00e9s \u00e0 la dur\u00e9e de vie de la batterie et \u00e0 l&rsquo;enroulement du papier. Ils ont exp\u00e9riment\u00e9 d&rsquo;autres mat\u00e9riaux de feutre, repens\u00e9 l&#8217;embrayage \u00e0 glissement et mis au point un nouveau pilote, entre autres activit\u00e9s.<\/p>\n\n\n\n<p>Toutefois, le projet a \u00e9t\u00e9 refus\u00e9 par l&rsquo;ARC. Elle a soutenu que les activit\u00e9s du demandeur, prises isol\u00e9ment, \u00e9taient routini\u00e8res : trouver le meilleur feutre \u00e9tait simple, la conception de l&#8217;embrayage \u00e0 glissement n&rsquo;avait pratiquement pas chang\u00e9 et les algorithmes d&rsquo;entra\u00eenement de l&rsquo;imprimante \u00e9taient connus de tous. Cependant, un juge, le juge D&rsquo;Auray, n&rsquo;\u00e9tait pas d&rsquo;accord avec l&rsquo;approche de l&rsquo;ARC, d\u00e9clarant : [102] \u00ab\u00a0Je suis d&rsquo;avis que les activit\u00e9s du demandeur ne sont pas routini\u00e8res :<\/p>\n\n\n\n<p><strong>[102] \u00a0\u00bb \u00c0 mon avis, le travail effectu\u00e9 au niveau du syst\u00e8me et de l&rsquo;imprimante \u00e9tait admissible au CII pour la RS&amp;DE en 2009 et en 2010 ; l&rsquo;appareil a \u00e9t\u00e9 am\u00e9lior\u00e9 \u00a0\u00bb [103].<\/strong><\/p>\n\n\n\n<p><strong>[Je ne suis pas d&rsquo;accord avec l&rsquo;approche analytique de l&rsquo;intim\u00e9, \u00e0 savoir que chaque activit\u00e9 devait \u00eatre analys\u00e9e s\u00e9par\u00e9ment&#8230; \u00ab\u00a0.<\/strong><\/p>\n\n\n\n<p>Le juge D&rsquo;Auray a vu que l&rsquo;incertitude technologique r\u00e9sidait dans la combinaison des technologies composant l&rsquo;imprimante, et non dans chaque domaine de d\u00e9veloppement.<\/p>\n\n\n\n<p>L&rsquo;approche consistant \u00e0 d\u00e9composer un projet de RS&amp;DE en activit\u00e9s isol\u00e9es a de nouveau \u00e9t\u00e9 r\u00e9fut\u00e9e par le juge D&rsquo;Auray dans <a href=\"https:\/\/decision.tcc-cci.gc.ca\/tcc-cci\/decisions\/fr\/item\/228699\/index.do?q=Formadrain%20Inc.\">l&rsquo;affaire Formadrain Inc. c. Sa Majest\u00e9 la Reine, 2017 TCC 42<\/a>. Ici, les projets du demandeur ont \u00e9t\u00e9 refus\u00e9s par l&rsquo;ARC parce qu&rsquo;ils ne r\u00e9pondaient pas aux crit\u00e8res d&rsquo;admissibilit\u00e9 de la RS&amp;DE. Le juge n&rsquo;\u00e9tait pas d&rsquo;accord, d\u00e9clarant :<\/p>\n\n\n\n<p><strong>[96] \u00a0\u00bb Il semble que r\u00e9duire l&rsquo;ensemble du projet de l&rsquo;appelant concernant le mandrin au seul aspect de la recherche de la formule chimique du caoutchouc est une vision simpliste du travail qui s&rsquo;est r\u00e9ellement d\u00e9roul\u00e9&nbsp;<\/strong><\/p>\n\n\n\n<p><strong>[99] \u00ab\u00a0L&rsquo;intim\u00e9e semble soutenir que je dois analyser le projet de fa\u00e7on isol\u00e9e et que chaque man\u0153uvre prise individuellement doit r\u00e9sulter en une incertitude technologique.&nbsp; Je ne suis pas d&rsquo;accord avec cette approche.<\/strong><\/p>\n\n\n\n<p>Ces d\u00e9cisions illustrent l&rsquo;importance de discuter de votre projet au plus haut niveau possible afin de s&rsquo;assurer que les activit\u00e9s sont interreli\u00e9es et admissibles \u00e0 la RS&amp;DE.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-relier-les-points-definir-des-objectifs-technologiques-clairs\"><strong>Relier les points : d\u00e9finir des objectifs technologiques clairs<\/strong><\/h2>\n\n\n\n<p>Commencez par d\u00e9finir clairement vos objectifs technologiques. Ensuite, \u00e9tudiez comment vos objectifs pourraient \u00eatre affect\u00e9s par les diff\u00e9rentes parties du syst\u00e8me, qu&rsquo;il s&rsquo;agisse d&rsquo;un produit ou d&rsquo;un processus.<\/p>\n\n\n\n<p>Pour relier le travail sur ces parties \u00e0 votre projet de RS&amp;DE, vous devez identifier l&rsquo;interd\u00e9pendance. Les aspects du syst\u00e8me sont interd\u00e9pendants si les changements apport\u00e9s \u00e0 une partie en affectent d&rsquo;autres qui sont, en fin de compte, li\u00e9es \u00e0 votre objectif. Il peut s&rsquo;agir de travaux apparemment routiniers qui ne seraient pas admissibles s&rsquo;ils \u00e9taient isol\u00e9s. Cependant, ces changements simples peuvent \u00eatre n\u00e9cessaires \u00e0 une partie du syst\u00e8me pour en exp\u00e9rimenter une autre. Consid\u00e9rez tous les travaux n\u00e9cessaires pour atteindre votre objectif.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-cadrer-votre-projet-de-rs-amp-de-au-plus-haut-niveau\"><strong>Cadrer votre projet de RS&amp;DE au plus haut niveau<\/strong><\/h2>\n\n\n\n<p>Les projets complexes n\u00e9cessitent une bonne perspective pour identifier l&rsquo;\u00e9ligibilit\u00e9 \u00e0 la RS&amp;DE. Si l&rsquo;on y regarde de trop pr\u00e8s, le travail peut sembler routinier. Cependant, en adoptant la perspective la plus \u00e9lev\u00e9e possible, sans \u00eatre trop vague, les incertitudes deviendront claires.
